Pavuno End User License Agreement
Effective date: October 31, 2026
This End User License Agreement ("EULA") is between you and H23Rx, LLC, a Wyoming limited liability company ("H23Rx," "we," "us," or "our"), and governs your use of the Pavuno mobile application (the "App"). The Pavuno Terms of Service (the "Terms") also apply and are incorporated into this EULA, including the arbitration agreement and class action waiver in Section 17 of the Terms. If this EULA conflicts with the Terms on the license to the App, this EULA controls.
1. License
The App is licensed, not sold, to you. Subject to this EULA, H23Rx grants you a personal, limited, revocable, non-exclusive, non-transferable license to download, install and use the App for your own non-commercial purposes on devices that you own or control, as permitted by the usage rules of the app store from which you obtained it (the "App Store"). Where an App Store's rules allow, the App may also be used by other accounts associated with you through family sharing or volume purchasing.
2. Restrictions
You may not, and may not allow anyone else to: (a) copy, modify, distribute, sell, rent, lease, lend or sublicense the App; (b) reverse engineer, decompile or disassemble the App or attempt to derive its source code, except to the extent applicable law expressly permits it despite this restriction; (c) remove or alter any proprietary notices; (d) circumvent any security, authentication or usage-limiting feature; or (e) use the App in violation of law or the Acceptable Use Policy.
3. Your data
You keep ownership of the information you enter in the App. Our collection and use of information is described in the Pavuno Privacy Policy and Consumer Health Data Privacy Policy. Apple Health and Android Health Connect connections are optional, require your permission on your device, and can be turned off in your device settings at any time.
4. Health and safety
The App is a personal tracking and organizational tool. It is not a medical device and does not provide medical advice, diagnosis, treatment, dosing recommendations or emergency monitoring. Decisions about medications, doses, injection sites and symptoms belong to you and your licensed healthcare provider. See the Medical and Medication Tracking Disclaimer.
5. Updates
We may provide updates, patches or new versions of the App. Some updates may be required to keep using the App or to keep it secure. This EULA applies to all updates unless they come with separate terms.
6. Third-party software and data
The App includes third-party software and data, including open-source components and nutrition data from Open Food Facts (made available under the Open Database License) and USDA FoodData Central. Those components may be subject to separate license terms or attribution requirements, which are listed in the App's settings under "Licenses and Acknowledgments." Those terms control your use of the components they cover.
7. Termination
This EULA is effective until terminated. Your rights under it end automatically if you fail to comply with it or the Terms. You may terminate it at any time by deleting the App from your devices. Deleting the App does not cancel a subscription or delete your account or the data stored in it; use the account deletion feature in the App or contact us to delete your account. Sections 2, 7, 8, 9 and 10 survive termination.
8. Disclaimer of warranties and limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. The warranty disclaimer and limitation of liability in Sections 14 and 15 of the Terms apply to the App. Nothing in this EULA limits rights you have under mandatory consumer protection law.
9. Export compliance
You represent that (a) you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and (b) you are not listed on any U.S. government list of prohibited or restricted parties. You will comply with all applicable U.S. export control and sanctions laws.
10. Governing law
This EULA is governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, and disputes are resolved as described in Sections 17 and 18 of the Terms.
11. Additional terms for Apple App Store users
If you downloaded the App from the Apple App Store, the following terms also apply, and they control if they conflict with any other part of this EULA:
- Acknowledgement. This EULA is between you and H23Rx only, not with Apple Inc. ("Apple"). H23Rx, not Apple, is solely responsible for the App and its content.
- Scope of license. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. H23Rx is solely responsible for providing any maintenance and support services for the App, as described in this EULA or as required by applicable law. Apple has no obligation to furnish any maintenance or support services for the App.
- Warranty. H23Rx is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any, to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are H23Rx's sole responsibility, to the extent not disclaimed.
- Product claims. H23Rx, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the App's use of the HealthKit framework. This EULA does not limit H23Rx's liability to you beyond what is permitted by applicable law.
- Intellectual property rights. If any third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, H23Rx, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints or claims about the App should be directed to: H23Rx, LLC, 777 Brickell Ave, Suite 500, Miami, FL 33131; support@h23rx.com.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the App, such as your wireless data service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
12. Additional terms for Google Play users
If you downloaded the App from Google Play, this EULA is between you and H23Rx only, not Google LLC ("Google"). H23Rx, not Google, is responsible for the App, its content, and its maintenance and support. Your use of the App is also subject to the Google Play Terms of Service, and Google's refund policies apply to purchases made through Google Play.
