Pavuno Terms of Service
Effective date: October 31, 2026
PLEASE READ THESE TERMS CAREFULLY. SECTION 17 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS AS DESCRIBED IN SECTION 17.8.
1. Who we are and what these Terms cover
These Terms of Service (the "Terms") are a binding agreement between you and H23Rx, LLC, a Wyoming limited liability company ("H23Rx," "we," "us," or "our"). They govern your use of the Pavuno mobile application, the Pavuno website, and related features and support (together, the "Service").
The following documents are part of these Terms and are incorporated by reference: the Pavuno Privacy Policy, Consumer Health Data Privacy Policy, Health Data Consent, Medical and Medication Tracking Disclaimer, Subscription, Trial and Cancellation Terms, Acceptable Use Policy, End User License Agreement, and Cookie Notice (together, the "Policies"). If a Policy conflicts with these Terms on a specific topic it addresses, that Policy controls for that topic.
By creating an account, clicking "I agree," or using the Service, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Service.
2. Pavuno is a tracking tool, not medical care
Pavuno helps you record and organize information you choose to enter, such as medications, doses, injection history, symptoms, weight, nutrition and other wellness information. Pavuno is not a healthcare provider, pharmacy, prescribing service, medical device, medical record system, or emergency service. H23Rx does not diagnose, treat, prescribe, recommend doses, select medications or injection sites, or monitor your health, and using the Service does not create a clinician-patient relationship. Always follow the instructions of your licensed healthcare provider and the approved product labeling. Never start, stop or change a medication or dose based on the Service. In an emergency, call 911 or your local emergency number. The Medical and Medication Tracking Disclaimer is part of these Terms.
3. Eligibility
- Age. You must be at least 13 years old to use the Service. Children under 13 may not use the Service or create an account. When you sign up, you confirm your age.
- Users aged 13 to 17. If you are 13 to 17 years old (or under the age of majority where you live), you may use the Service only if your parent or legal guardian has reviewed and agreed to these Terms and the Policies. When you sign up, you confirm this by checking the box provided. Your parent or guardian is responsible for your use of the Service and may ask us to close your account at any time by contacting support@h23rx.com.
- Adult-only features. Peptide tracking features and purchases made on our website are available only to users 18 or older, who confirm their age before using them.
- Legal capacity. If you are 18 or older, you confirm that you can form a binding contract and are not barred from using the Service under applicable law.
We may ask for information to confirm eligibility and may suspend or close accounts that do not meet these requirements.
4. Your account
You agree to provide accurate account information and keep it up to date, keep your sign-in credentials confidential, not share your account, and notify us promptly at support@h23rx.com if you suspect unauthorized access. You are responsible for activity on your account that results from your failure to protect your credentials. You may track information about another person (for example, a family member in your care) only if you have the legal authority to do so.
5. Your content
"Your Content" means information you enter, import, scan or upload, including health logs, notes, food photos and exported reports. You keep all ownership rights in Your Content. You grant H23Rx a limited, non-exclusive, royalty-free, worldwide license to host, store, process, transmit, back up, display and export Your Content solely to operate, secure and provide the Service to you, to follow your instructions, and to comply with law. This license ends when Your Content is deleted from our systems, except for copies we must keep by law or that remain in backups for the limited period described in the Privacy Policy. We may also create de-identified, aggregated information from Your Content and use and share it as described in the Privacy Policy; de-identified information is not Your Content. We do not sell Your Content, and we do not use your health information for advertising.
You are responsible for the accuracy of Your Content and for confirming that you have the right to submit it. Review records before you rely on them or share them with anyone, including a clinician.
6. Food scanning and AI estimates
Where available, the Scan Food feature may read packaged-food barcodes or analyze a photo of a meal and return an estimated nutrition result. Food photos are sent to a third-party artificial intelligence service to generate the estimate, as described in the Privacy Policy. Estimates are approximate and may be wrong. Nothing is added to your records until you review the result, adjust it if needed, and tap Save. Do not rely on any estimate for allergy safety, medication dosing or other medical decisions.
7. Health integrations, reports and exports
You may choose to connect Apple Health or Android Health Connect, create PDF reports, or export your data as CSV or JSON. These features are optional and controlled by you. Device permissions are managed in your device settings, separately from these Terms. Reports and exports are summaries of information recorded in the Service. They are not verified clinical records, and Pavuno does not send them to anyone unless you choose to share them. Once you share an export, the recipient's handling of it is outside our control.
8. Acceptable use
You agree to follow the Acceptable Use Policy. Among other things, you may not access other accounts, bypass security, scrape or reverse engineer the Service except as permitted by law, upload malicious code, impersonate others, falsify medical records or prescriptions, or use the Service for any unlawful purpose.
9. Subscriptions and payments
Pavuno offers a free plan and a paid subscription, Pavuno Plus. Prices, free-trial terms, automatic renewal and cancellation are described at checkout and in the Subscription, Trial and Cancellation Terms, which are part of these Terms. Subscriptions renew automatically until you cancel. Purchases made through the Apple App Store or Google Play are billed and managed by that store and are also subject to its terms. Purchases made on our website are processed by Stripe. Deleting the app or your account does not cancel a subscription.
10. Third-party services
The Service works with third-party services such as app stores, payment processors, cloud hosting providers, sign-in providers, Apple Health, Android Health Connect, wearable and health-device services you choose to connect, food databases (including Open Food Facts and USDA FoodData Central), AI providers, and analytics and measurement providers. We are not responsible for third-party services we do not control, and your use of them may be subject to their own terms and privacy policies.
11. Our intellectual property
The Service, including its software, design, text, graphics, logos and the Pavuno name, is owned by H23Rx or its licensors and is protected by intellectual property laws. Subject to these Terms and the End User License Agreement, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for your own non-commercial purposes. If you send us feedback or suggestions, we may use them without obligation to you.
12. Changes to the Service
We may add, change, suspend or discontinue features at any time, and we may change which features are included in the free plan or Pavuno Plus. If we discontinue a paid feature during a subscription period you have paid for, we will provide a pro-rated refund for the unused period of a direct web purchase, or direct you to the app store's refund process where the store handles billing, unless the law requires otherwise. Reminders and notifications can be delayed or fail because of device settings, network problems or other causes. Do not rely on the Service as your only reminder to take a medication.
13. Suspension and termination
You may stop using the Service and delete your account at any time from the app settings or by contacting us. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if needed to protect the Service, other users or the public. Where reasonable, we will give you notice and an opportunity to export Your Content. Sections 5 (last paragraph), 11, and 14 through 19 survive termination.
14. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." H23RX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT REMINDERS WILL BE DELIVERED, OR THAT ANY INFORMATION, ESTIMATE, CHART OR REPORT IS ACCURATE OR COMPLETE. YOU ARE SOLELY RESPONSIBLE FOR HEALTH DECISIONS YOU MAKE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) H23RX AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THEIR POSSIBILITY; AND (B) H23RX'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (1) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (2) ONE HUNDRED U.S. DOLLARS (US \$100).
These limitations apply to all theories of liability, including contract, tort (including negligence), product liability and statute. They do not limit liability that cannot be limited by law, such as liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence where such limitation is prohibited.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless H23Rx and its members, managers, employees and contractors from third-party claims, losses and reasonable expenses (including attorneys' fees) arising from (a) your violation of these Terms or the Acceptable Use Policy, (b) your violation of law or the rights of another person, or (c) health or other information about another person that you submit without authority. This section does not apply to claims caused by our own breach or negligence.
17. Dispute resolution, binding arbitration and class action waiver
17.1 Informal resolution first. Before starting arbitration or a court case, you and H23Rx agree to try to resolve any dispute informally. The party raising the dispute must send a written notice describing the claim and the relief requested (to us at support@h23rx.com, or to you at the email address on your account). Both parties will negotiate in good faith for 60 days after the notice is received, including, if either party asks, a phone or video call. Statutes of limitation are paused during this period.
17.2 Agreement to arbitrate. If the dispute is not resolved informally, you and H23Rx agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by final and binding individual arbitration, not in court, except as stated in Section 17.3. The arbitrator decides all issues, including the scope and enforceability of this agreement to arbitrate, except that a court decides issues about Sections 17.5 and 17.7.
17.3 Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies, and (b) seek an injunction in court to stop infringement or misuse of intellectual property or unauthorized access to the Service.
17.4 Rules and procedure. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at adr.org. The Federal Arbitration Act governs this Section 17. The arbitration will be conducted by a single arbitrator, by video conference or on written submissions where permitted, or in person in the county where you live if you prefer. Payment of filing, administrative and arbitrator fees will follow the AAA Consumer Rules, and we will pay any fees those rules require the business to pay. The arbitrator may award the same individual relief a court could, including statutory damages and attorneys' fees where the law allows.
17.5 Class action and jury trial waiver. YOU AND H23RX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND H23RX WAIVE ANY RIGHT TO A JURY TRIAL. The arbitrator may not consolidate claims of more than one person or award relief to anyone other than the individual party bringing the claim.
17.6 Mass filings. If 25 or more similar demands are filed against H23Rx by or with the help of the same law firm or coordinated group, the AAA's Mass Arbitration Supplementary Rules will apply, and the demands may be administered in batches, with fees assessed per batch where those rules allow.
17.7 Severability of this Section. If the class action waiver in Section 17.5 is found unenforceable for a particular claim or type of relief (such as public injunctive relief), that claim or relief will be separated and decided by a court under Section 18, after the individual claims are arbitrated, and the rest of this Section 17 will still apply.
17.8 Your right to opt out. You may opt out of this agreement to arbitrate by emailing support@h23rx.com within 30 days after you first accept these Terms, stating your name, the email address on your account, and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
17.9 Changes to this Section. If we make a material change to this Section 17, it will not apply to any Dispute of which we had notice before the change, and you may reject the change by emailing us within 30 days after it takes effect.
18. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules, and by the Federal Arbitration Act for Section 17. Any Dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Wyoming, and you and H23Rx consent to their personal jurisdiction. Nothing in these Terms takes away consumer protection rights you have under the mandatory laws of the place where you live.
19. General terms
- Changes to these Terms. We may update these Terms. If a change is material, we will notify you in the app or by email at least 30 days before it takes effect, unless the change is required by law or addresses security. If you keep using the Service after the effective date, you accept the updated Terms. If you do not agree, you must stop using the Service and may cancel your subscription.
- Entire agreement. These Terms and the Policies are the entire agreement between you and H23Rx about the Service and replace any prior agreements on that subject.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will stay in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganization or sale of assets, with notice to you.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of third-party providers, natural disasters, war, labor disputes or government action.
- Notices. We may send notices to the email address on your account or in the app. You may send legal notices to support@h23rx.com or by mail to the address below.
- Export and sanctions. You may not use the Service if you are located in a country subject to a U.S. government embargo or are on a U.S. government restricted-party list.
- California users. Under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
